Your Options in Bankruptcy

Many have heard that the bankruptcy laws have changed and that it is much more difficult to file for bankruptcy. This not true. The bankruptcy laws provide a number of procedures to meet different needs:

  • Chapter 7 - also known as liquidation
  • Chapter 11 - also known as business reorganization
  • Chapter 12 - also known as family farmer
  • Chapter 13 - also known as wage earners

Chapter 7

Chapter 7 bankruptcy is the fastest, cheapest and easiest proceeding. Most debts can be wiped out. If you have been current on your mortgage and car payments, you may be able to keep those items.

Chapter 11

Chapter 11 is for both individuals and business. It allows you to reorganize your finances while keeping assets with substantial equity.

Chapter 12

Farmers and fishermen with regular incomes may apply for this form of protection, which is specially suited to their circumstances and assets.

Chapter 13

This reorganization allows you to keep substantial assets if they are the subject to secured debts. Even if you are in the midst of foreclosure or a repossession action, you may be able to keep your home, car, boat, or other secured assets. You must make payments faithfully according to a reorganization plan. When you have completed your payments, all remaining unsecured debts are wiped out.
