Trusts. A trust is an alternative to a will. You may transfer assets into your trust. The trust will continue to own those funds after your death. Upon your death, you will be replaced as "trustee" by another person who will act as trustee. A major benefit is that assets placed in the trust are not subject to probate.

Trusts can also be helpful when dealing with the complexities of modern marriages and families. If you are remarried, but you want to make sure that your children from your former marriage receive your estate, you can fund a trust now, and its proceeds can be held for those children until they reach maturity.

Elder Law
